Four Killed in Christmas Day Head-On Collision

CarCrash2

Four people were killed in a head-on auto accident on Christmas Day, according to officials with the Florida Highway Patrol. According to the FHP, a man in a Buick was in the wrong lane when he was traveling on State Road 70 by Lake Placid and ran into a vehicle that was in the correct lane. The driver and one passenger in the Buick died as well as the driver and one passenger in the vehicle it struck.

A head-on collision is an accident that involves two vehicles crashing into the front ends of each other. These accidents typically result in serious injuries and many times even death. An experienced car accident attorney can help ensure that you receive the compensation you are entitled to if you or your loved one has been injured in one of these accidents.

Filing a Lawsuit After a Head-On Car Accident

Head-on car accidents are often caused by a driver that is being negligent. When filing a lawsuit against the negligent party, the injured person, or their surviving loved one, just prove that the negligent driver breached their duty to exercise due care when traveling. This means that the driver was not acting in a manner that would avoid foreseeable risk to other drivers on the road like other driver would. The victim of the accident must also show that the driver’s negligent behavior resulted in the accident that caused the victim’s injuries.

Situations that often result in head-on car accidents that may indicate negligence include, but are not limited to, the following:

  • A driver who uses bad judgement when passing other vehicles.
  • Turning a corner too sharply.
  • Attempting to avoid debris, an animal, or other object in the road.
  • A driver who falls asleep when driving.
  • Poor weather that leads to a decrease in visibility.
  • A driver who is impaired due to alcohol or drugs.

In certain situations, there could be more than one driver that was negligent and caused the accident. An experienced Florida car accident attorney can help determine which parties may be at fault. In Florida, the court will evaluate for damages based on the theory of comparative negligence. This means that each party will be assigned a percentage of fault and that party’s compensation could be reduced based on that percentage of fault.

Compensation for Head-On Collisions

Although it isn’t just head-on car accidents that have the potential to be serious, this type of accident seems to cause the most significant damage. Some of the serious injuries that may be caused by a head on collision include, but are not limited to, the following:

  • Spinal cord injuries including paralysis
  • Head and brain trauma
  • Whiplash
  • Lacerations and severe bruises
  • Broken bones

Some of these injuries may require years to recover, and others may be permanent and life altering. Victims who suffer from such severe injuries may need monetary assistance in order to get the care they need. These victims may also be able to recover expenses for past and future medical costs, rehabilitation expenses, loss of wages, pain and suffering, and more.

If your loved one lost their life due to such an accident, a surviving family member may be able to file a wrongful death claim to obtain damages for funeral and burial costs, medical expenses, and more.
